Arbitration &
Mediation Rates

$350 per hearing/consulting hour, plus travel and study time, unless other arrangements are made. Minimum of eight (8) hours per day for out-of-town proceedings, plus expenses for travel, meals and lodging. 50% of anticipated hourly rate, plus expenses for travel are due made no later than 48 hours (2 days) before the date of travel/hearing. Rates for conference rooms at Quatman ADR’s offices can be quoted on an as-need basis, depending on availability.


Expert Witness
Fees & Expenses

$350/hour for normal review, research and consultation

$400/hour for depositions – minimum four (4) hours ($1,600)

Trial attendance (non-testifying) is a flat $3,000/day

Trial/arbitration testimony appearances are billed at a flat $4,000/day

Trial consulting (non-testifying) on location can be billed hourly, at $350/hour, or a flat daily rate of $3,500/day, including meetings with attorneys, clients, trial attendance, input and advice on witness examination, etc.

A retainer of $5,000 for preliminary review of case materials and phone/in-person consultation will be due prior to initiation of any expert services. The retainer serves as a deposit toward fees and expenses incurred. Monthly statements will be sent itemizing the fees and expenses deducted from the retainer. If the services exceed the initial retainer, then an itemized invoice will be sent for additional fees and expenses. A written Expert Witness Agreement will also be required, signed by the law firm retaining Mr. Quatman. All fees and expenses will be billed to, and be the responsibility of, the law firm. All invoices are due within seven (7) days of the date of the invoice, which will be sent by email to the designated person. Late payments will accrue interest at the rate of 10% per annum.

If payment is not made within twenty-one (21) days from date of invoice, Quatman ADR will suspend all services without liability for delay, upon written notice.

When deposition fees are the responsibility of the opposing party/counsel, the minimum flat rate of $1,600 is payable in advance of deposition, or by presentation of a check before the deposition begins. If the deposition is scheduled outside of Kansas City, then payment must be received prior to travel. Hours longer than four (4) will be billed to the appropriate party after the deposition concludes.

Terms of retainer, rates and timing of payment is subject to change based on client’s payment history.


Travel Fees
& Expenses

For out-of-town travel, the rate is $150/hour for travel time, plus expenses of meals, lodging, travel at the rate incurred, with no markup. Alternatively, a flat $1,500/day for up to ten (10) hours in transit, with $150/hour after ten (10) hours, plus expenses.


International
Matters

For international matters, contact Quatman ADR for special terms.

All payments must be in U.S. dollars.

 

Billing

All parties are asked to make a pre-payment (50% of anticipated hourly rate plus expenses for travel) toward arbitration or mediation costs and fees. Any unused portion will be refunded upon conclusion of the arbitration or mediation and/or the parties will be billed for the additional balance due. If the proceedings continue more than thirty (30) days beyond the initial session, interim billings will be made monthly. Responsibility for fees is worked out on a case-by-case basis; fees are usually divided equally between the parties, unless other agreements are reached. All fees are due within seven (7) days from receipt of an invoice.

Cancellation Notice & Fees

Quatman ADR blocks out dates for your matter, as agreed with the parties. Notice of postponement or cancellation must be in writing to Quatman ADR, which may be sent by email. A late postponement or cancellation fee will be charged equal to two (2) hours at the arbitrator/mediator’s hourly rate in addition to any time actually spent on the case prior to receipt of Notice, if the notice of postponement or cancellation is received within 10 (ten) business days of the scheduled proceeding and we are unable to reschedule another matter on the reserved date(s). The postponement or cancellation Notice must be received by Quatman ADR before 5:00 p.m. CST on the 10th (tenth) business day preceding the date of the reserved date to avoid the cancellation charge.

Payment Terms

We provide two options for payment:

  1. By Check: Fees and expenses may be paid by check payable to “Quatman ADR, LLC.”

  2. By PayPal: If a party prefers, an invoice will be sent from PayPal and may be paid online with a credit card.

In either event, payment must be received at least 48 hours prior to the scheduled proceedings. Failure to make payment will result in the cancellation of the proceeding. Fees associated with cancellation and rescheduling will be the responsibility of the party (or parties) who failed to make timely payments.

Lunch & Drinks

Lunch can be provided to the parties on-site at an arbitration or mediation from a local restaurant, with each party responsible for its own expenses. Soft drinks, juices, and bottled water will be available if the proceeding is held at Quatman ADR’s office, at no added cost.
