Co-mediation
Definition:
Co-mediation happens when two or more mediators work together, a process that parties might wish to consider in multi-party complex cases, where mediators work together as a team. The mediators can divide issues and parties according to expertise, suitability, and compatibility, while also coordinating their tasks. For example, one mediator can work with the project owner, the design experts, and the general contractor, while the other mediator can work with the general contractor and its subcontractors, or insurers. Both mediators meet during the process to compare notes in hopes of resolving some, or all, of the disputes. If an impasse is encountered with some parties, the co-mediators may then focus on other parties or claims to make progress – while leaving other disputes or parties to proceed to arbitration or court.
